Our terms of use

Article 1: Purpose

These Terms of Use (hereinafter referred to as the “Terms”) govern the entire relationship between SUSTY, a limited liability company with a share capital of €30,000.00, whose registered office is located at 14 Rue Paul Chatrousse, 92200 Neuilly-sur-Seine – France, registered with the Trade and Companies Register of Nanterre under number 935 302 596, and users of the platform accessible at www.sustyfabrics.com (the “Platform”).

Article 2: Platform Overview

SUSTY provides, via its website www.sustyfabrics.com, a platform offering decorative items such as upholstery fabrics, furniture, artworks, and other textiles. It connects textile manufacturers and/or fabric editors (the “Partners”), wishing to sell their dormant or unsold fabric stock, with individual or professional buyers (the “Users”), and/or directly sells products through SUSTY.

The identity of the seller (SUSTY or Partner) is indicated on the product page for each item listed for sale.
When a sale is made between a Partner and a User, SUSTY acts solely as an intermediary.

Article 3: Access and Acceptance of the Terms of Use

Access to and use of the Platform are subject to the following cumulative conditions:

  • Creation of an account (the “Account”);

  • Being at least 18 years of age;

  • Reading and accepting these Terms by checking the appropriate box;

  • Reading and accepting the Privacy Policy available via the following link: [insert link], by checking the appropriate box.

The User agrees to read these policies before using the Platform.

These Terms are originally written in French, which shall prevail over any translation that may be made available in another language.

Article 4: Content of the Terms

The Terms are published by SUSTY, whose legal notices are available under the "Legal Notices" tab.

SUSTY reserves the right to modify or update the Terms at any time, without prior notice and at its sole discretion. These changes shall take effect upon publication on the Platform. Users are encouraged to consult the Terms regularly.

SUSTY also reserves the right to modify, suspend, or remove any content, feature, or part of the Platform at any time, to limit certain functionalities, or to restrict access, without notice and at its sole discretion.

Article 5: Equipment

It is the User’s responsibility to ensure that their hardware (such as PC, tablet, smartphone, and associated software) and Internet connection are appropriate for optimal and secure use of the Platform.

Article 6: User Obligations

When using the Platform, the User agrees to:

  • Comply with all applicable laws and regulations and not infringe upon third-party rights, public order, or public decency;

  • Share only relevant, truthful, up-to-date, and necessary information for the proper execution of the Platform’s services;

  • Share only lawful content for which they hold the necessary rights and authorizations to publish on the Platform;

  • Act with discernment, caution, and courtesy in all interactions (especially with customer service).

SUSTY reserves the right, at its sole discretion, to (i) immediately suspend User access, (ii) suspend or terminate access to the Platform, (iii) remove any content or information provided by the User, (iv) notify any relevant authority, and/or (v) take any action permitted by law.

Article 7: SUSTY's Liability

SUSTY does not guarantee uninterrupted service or a Platform free of bugs or viruses.
The User acknowledges and accepts the limitations of the Internet, including that:

(i) use of the Platform is at their own risk;
(ii) the Platform is provided “as is” and based on availability;
(iii) the User is responsible for protecting their own equipment from potential threats.

SUSTY disclaims all liability in the event of interruption, suspension, or malfunction of the Platform.

Article 8: Intermediation Service

SUSTY allows its professional Partners to list and sell their products on the Platform. The Partner’s identity is clearly displayed on each product page.

In this respect, SUSTY acts as a host by facilitating transactions but is neither the buyer nor the seller of products sold by Partners.

SUSTY merely provides a meeting point where buyers (Users purchasing one or more items from Partners) and Partners complete transactions. A contract of sale is formed solely between the Buyer and the Partner. SUSTY is not party to this contract and accepts no liability arising from or related to its execution.
The Partner alone is responsible for the sale, claims, and any issue relating to the sale agreement.

The connection between the Partner and the User does not imply any obligation to purchase.

Article 9: Intellectual Property

All content on the Platform — including, but not limited to, images, music, films, photos, drawings, logos, trademarks, texts, icons, architecture, databases, and software — is protected by intellectual property laws.

Access to and use of the Platform do not grant any rights or licenses over this content.
Any reproduction, in whole or in part, is strictly prohibited.

Article 10: Account

Users may create an Account by clicking on “My Account” and then “Sign Up.”

They must provide their first and last name, and/or professional details if applicable (e.g., company name, legal form), email address (as login), and password. They must also indicate their preferences regarding the newsletter by checking the corresponding boxes.

The personal password must be at least 8 characters long, including both letters and numbers, and no more than 11 characters. All account information must be accurate and updated when necessary.

Users can log into their Account at any time via the “My Account” → “Log In” section.

The Account allows Users to order products, track their orders, view their purchase history, and access invoices (for professional Users).
SUSTY is not responsible for the User's choice or use of their login credentials. The User is solely responsible for maintaining the confidentiality of their password and account details, and for all actions taken via the Account.

The User must notify SUSTY immediately of any unauthorized use or security breach — suspected or confirmed.

Article 11: Personal Data

The terms and conditions for processing personal data provided by the User to SUSTY via the Platform are detailed in the Privacy and Cookie Policy.

Article 12: Customer Service

In case of any issue with the Platform, particularly regarding the Account, Users may contact SUSTY customer service at: contact@sustyfabrics.com

Article 13: Governing Law

These Terms are governed by French law.

Article 14: Jurisdiction

Any dispute between SUSTY and a User relating to these Terms and/or the use of the Platform that cannot be resolved amicably shall fall under the exclusive jurisdiction of the French courts.
